Protected class is all people that are over 40 years old, it a group of persons protected by specific laws because of the groups defining characteristics. Under the laws prohibiting employment discrimination, these characterizes include race, color, religion national origin, gender, age and disability. Employment discrimination is treating employees or job applicants unequally on the basis of race, color national origin, religion gender, age, or disability, prohibited by federal statutes. Intentional Discrimination is when employer know that he-she doing this Intentionally with awareness and is know as disparate treatment discrimination because intent may sometimes be difficult to prove, courts have established certain procedures for resolving disparate treatment cases. Discrimination based on race, color and national origin is NOT allowed. If a company’s standards or policies for selecting or promoting employees have the effect of discriminating against employees or job applicants on the basis of race, color or national origin they are illegal. Title 7 of the Civil Rights Act of 1946 also prohibits government employers, private employers, and unions from discriminating against persons because of their religion or based on gender as well for Sexual harassment in the workplace. Sexual Harassment has often been classified as either quid pro quo harassment. Online Harassment is when employee’s online activities can create hostile working environment in many ways. Racial jokes, ethnic slurs, or other comments contained in e-mail may become the basic for a claim.
